Terms of Service – Commonplace

1. Using Commonplace
We grant you a personal, limited, non-transferable licence to use Commonplace in line with these terms. You may use the app only for lawful, personal purposes.
You must be over 16 and old enough to use online services where you live.
Do not misuse the app — for example, by posting illegal content, interfering with security, or attempting to access data you don’t have rights to.
We may update, suspend, or change the app or these terms when needed to improve the service or meet legal requirements.
2. Your Content
As between us and you, you own your entries (text, images, audio, and other material).
You grant us a limited, revocable licence to store and process your content only to provide the Commonplace products and services (sync, OCR, transcription, backups you request).
You are responsible for your content and its lawfulness.
Entries are not intended to include personal data. Please avoid adding personal information about yourself or others to entries.
3. Subscriptions and Billing (iOS)
Subscriptions and free trials are handled by Apple.
RevenueCat verifies your entitlement so features unlock across devices.
Apple’s terms govern purchase, renewal, cancellation, and refunds.
Manage your subscription in your Apple ID settings.
4. Privacy
Our Privacy Policy explains how we collect, use, and protect your information. It also describes where data is processed, including in the United States, and the safeguards we apply for international transfers. The Privacy Policy forms part of these terms.
5. Intellectual Property
We own all rights in the Commonplace app, website, software, and branding, including design, layout, and content structure. You may use them only as permitted under these terms. You may not copy, modify, distribute, decompile, or reverse engineer any part of the service except where allowed by applicable law.
6. Service Changes and Availability
We may add or remove features. We aim for reliability but can’t guarantee uptime or data preservation. We aren’t liable for losses caused by downtime or events outside our control.
The service infrastructure and storage are operated by trusted providers, which may be located in other countries. This does not change your rights under our Privacy Policy or applicable law.
7. Ending Your Use
You can stop using Commonplace any time. We may suspend or end access if you breach these terms or for security reasons. You can request account and data deletion by emailing us.
8. Disclaimers and Liability
Commonplace and its content are provided “as is.” We don’t make any promises about the app’s accuracy, reliability, or availability.
To the fullest extent allowed by law, we’re not responsible for any indirect, incidental, or consequential losses, or for loss of data or profits.
If we’re found to have liability, it will be limited to the amount you paid for the service in the 12 months immediately before the claim (if any).
Nothing in these terms excludes or limits any rights you have that cannot legally be excluded, such as rights under consumer-protection law.
9. Governing Law
These terms and any disputes are governed by Irish law. Consumers in the EU will also enjoy any mandatory protections of their own country’s laws.
The courts of Ireland have non-exclusive jurisdiction, meaning you may bring a claim in Ireland or, where the law requires, in your local courts.
10. Changes
We may revise these terms as the service evolves. We’ll update the date above and notify you in-app if changes materially affect your rights.
11. Security and Fair Use
To protect the service for everyone, we apply reasonable fair‑use measures such as rate limits and daily quotas. Attempts to bypass or interfere with these protections may result in temporary or permanent blocks.
For security and abuse prevention only, we maintain minimal technical logs. These may include your account identifier (if signed in), a daily‑rotated hash of your IP address, the part of the service you used (route), result codes, simple counters (e.g., requests in short windows), and timestamps. We do not log your content (entries, images, audio, or extracted text) in these records.
Raw security logs are kept for up to 30 days. We may retain anonymised aggregates for longer to improve reliability. For details on how we handle your information, see our Privacy Policy.
